Terms of Use for DeskMotion products

These Terms of Use govern access to xolvarynex.world and the purchase of DeskMotion office movement products coordinated by Xolvarynex from the United Kingdom studio.

By browsing, requesting proposals, or signing an order form, you agree to the obligations below unless a separate written agreement explicitly replaces a section.

Definitions used throughout these terms

DeskMotion refers to the movement coaching brand, Xolvarynex refers to the publishing entity controlling editorial content, and Client refers to the organisation purchasing services.

Products include Motion Spark Clinic, Collaborative Pulse Day, and Seasonal Alignment Pass bundles described inside Movement Catalog.

Website licence and acceptable use

DeskMotion grants a limited, revocable licence to view pages for legitimate workplace procurement research.

You may not attempt to disrupt servers, scrape content for competing datasets, or misrepresent affiliation with DeskMotion when contacting third parties.

Automated high-volume requests that degrade performance may be throttled or blocked after notice when contact details are available.

Orders, pricing, and taxes

Published United Kingdom pound prices include applicable value added tax unless a written quote states otherwise for exempt entities that supply valid exemption certificates.

Quotes remain valid for thirty days and DeskMotion may decline orders if safety questionnaires reveal incompatible building conditions.

Invoices are payable within fourteen days for corporate accounts unless alternative net terms appear on signed paperwork.

Scheduling, cancellations, and weather

Clients may reschedule onsite visits without penalty when DeskMotion receives at least five business days of notice.

Cancellations inside forty-eight hours may incur a fee equal to thirty percent of the day rate to cover coach travel blocks already reserved.

Severe weather that closes public transport may trigger mutual rescheduling without penalty once government guidance confirms disruption.

Intellectual property rights

All choreography scripts, printable cue cards, and branded templates remain owned by DeskMotion while clients receive a non-transferable licence to use them internally during the contract term.

Clients may not upload DeskMotion materials to public marketplaces or reuse them for paid training outside their organisation without written expansion rights.

Confidentiality and media capture

Each party agrees to protect non-public business information learned during planning calls and onsite visits for at least two years.

Optional promotional photographs require separate releases naming permitted channels and retention periods.

Warranties and limitations

DeskMotion warrants that coaches hold relevant movement facilitation training and that sessions will be delivered with reasonable skill and care for office contexts.

DeskMotion does not guarantee specific productivity metrics because outcomes depend on leadership support, environmental factors, and participant engagement.

To the fullest extent permitted by law, DeskMotion aggregate liability arising from any single engagement is limited to the fees paid for that engagement.

DeskMotion is not liable for indirect losses such as lost profits except where such exclusion is prohibited by mandatory United Kingdom law.

Indemnity

Clients indemnify DeskMotion against third-party claims arising from unsafe facilities, undisclosed hazards, or instructions that contradict building policies when the client insisted on proceeding.

Force majeure

Neither party is liable for delays caused by events beyond reasonable control, including power outages, strikes, or government mandates, provided timely notice and mitigation efforts occur.

Governing law and disputes

These terms are governed by the laws of England and Wales, and courts in London hold exclusive jurisdiction unless mandatory consumer protections require otherwise.

Parties agree to attempt good-faith negotiation for thirty days before initiating formal proceedings except for urgent injunctive relief relating to intellectual property misuse.

Changes to these Terms of Use

DeskMotion may update these terms to reflect new products or regulatory guidance, posting the effective date on this page and notifying active clients by email when changes materially affect pricing or liability.
